Islamic Education Trust is the real owner of Government Islamia College Complex Building Karachi. On behalf of Islamic Education Trust, we have no objection if the City District Government in Karachi may cancelled ninety-nine years lease of plot number 490, M.A. Jinnah Road, Jamshed Quarter, Karachi, Pakistan.

 

Islamic Education Trust has refuse to comply the clause number four of the agreement’s further on the following term and condition with Karachi Municipal Corporation now a day known as City District Government in Karachi vide their resolution number 1255 dated 27th May, 1958 by building ground and three floors but according to agreement only ground and first floor are allowed.

 

On above ground City District Government in Karachi may cancelled ninety-nine years lease of plot number 490, M.A. Jinnah Road, Jamshed Quarter, Karachi, Pakistan for the sake to save future of thousands of students in Government Islamia College Complex Building Karachi.

 

An early positive reply is kindly requested.

Your Excellency The Governor Of Sindh:

 

A) Islamic Education Trust is the owner of Government Islamia College Complex Building Karachi. On behalf of Islamic Education Trust, we have no objection if the Sindh Government takes over the Government Islamia College Complex Building Karachi.

 

B) If the Sindh Government pays dues to the Islamic Education Trust, the money should be distributed among deserving students for scholarship and other welfare projects and a society should be established for the purpose and the rent money (dues); should not be given to trustees since there were chances of corruption and misuse of funds.

 

C) Reference to our official meeting dated 29th October, 2008 at around 4:30pm among the Governor Of Sindh along with Special Secretary to Governor Of Sindh and the Trustee/General Secretary Syed Kamran Hussain along with Founder Trustee Mrs. Mumtaz Muzakkir of the Islamic Education Trust.

 

C1) Please refer to the dated 29th October 2008 official meeting among us. We are sorry to state that, while we are all our ready and willing to help the Government Of Sindh in the saving the Educational Institutions situated within the Islamia College Complex Building Karachi, the sub-ordinate office of Your Excellency the Advocate General Sindh, is all out to frustrate the efforts initiated by us for saving the Educational Institutions as above said.

C2) Your Excellency may recall that above referred meeting was arranged by Your Excellency’s Special Secretary Ms. Rabiya Javeri who remained in touch with our General Secretary Syed Kamran Hussain. Our General Secretary in compliance of your Government Of Sindh desire in extending our support for saving the Educational Instiutions in Islamia College Complex Karachi made applications for becoming party in the first rent appeal number 69 of 2008 (Principal Islamia Law College Karachi V/s The Official Assignee of Karachi) pending in the court of 3rd Additional District Judge Karachi East and execution number 17 of 2008 of rent case  number 17 of 2008 of rent case  413 of 2004 (The Official Assignee of Karachi V/s CDGK and Others) pending in the court of 3rd Rent Controller Karachi East. It will not be out of place to mention that we extended our all out support to the Sindh Education Department, so much so, that our legal advisor helped the Sindh Government in drafting the applications under section 12 (2) CPC for recalling the eject order which are pending in the Court of 3rd Rent Controller Karachi East. We may also mention that we have ourselves submitted application under section 12 (2) CPC and other application from our Islamic Education Trust, in the court of 3rd Rent Controller Karachi East, in execution number 17 of 2008 of rent case number 413 of 2004. It is because of our unconditional and untiring efforts that the group who want to take over the building and land of Islamia College Complex Building Karachi is unable to fulfill their desires.   

 

C3) That in order to completely knock out the group of Mrs. Afroze Shah w/o Syed Anwar Ali Shah r/o Syed Mohalla, Bhiria, Noushehro Feroz II, Sindh, Pakistan, who want to take over the building and the land of Islamia College Complex Building Karachi, we had to file a civil suit under section 92 CPC. It is further stated that the said civil suit cannot be filed unless the permission under section 92 CPC is granted by the Advocate General Sindh to the members of our trust. In this regards, we in the first instance, long before the meeting dated 29th October, 2008 among Your Excellency along with Special Secretary to Governor Of Sindh and our Trustee/General Secretary along with our Founder Trustees, had applied for required permission under section 92 CPC from the office of the Advocate General Sindh who were very much pleased to refuse the same vide their letter number AG-2043 of 2008 dated 13th June, 2008. We again through our counsel sent another letter dated 10th July, 2008 but the office of the Advocate General Sindh who were very much pleased to refuse the same vide their letter number AG-2617 of 2008 dated 06th August, 2008. Why The Advocate General Sindh was once again pleased to refuse the permission as required under section 92 CPC and instead of complying with the provision of section 92 of CPC tendered his advice that we should become a party in the High Court Appeal Number 06 of 2008 (Advocate General Sindh V/s Islamic Education Trust and Others) which is pending before the Honourable High Court of Sindh, Karachi?  

 

C4) That after the above referred our official meeting dated 29th October, 2008, we again prepared another civil suit seeking removal of Mst. Afroze Shah and others from the Islamic Education Trust and again applied for permission under section 92 CPC our letter dated 15th November, 2008 from the Advocate General of Sindh. It may be mention that the Advocate General of Sindh is again pleased to refuse our permission under section 92 CPC their letter number AG-4021 of 2008 dated 22nd December, 2008, with out any lawful reason.

 

C5) That our counsel have agitated the matter with the Advocate General of Sindh and in this regards a letter by our counsel wrote to the Advocate General Sindh dated 2nd January, 2009 has been sent on same date.

 

C6) That it will not out be place to mention that the Advocate General Sindh office is pleased to grant permission under section 92 CPC dated 23rd January, 2008 to the Mst. Afroze Shah and others in her group even after filing of a civil suit 107 of 2008 by them in the High Court of Sindh, Karachi dated 10th January, 2008. The Advocate General Sindh office is also pleased to grant permission as required under section 92 CPC letter number AG-5573 of 2007 dated 7th December, 2007 to the Mr. Sabir Qureshi and others in his group who have filed their civil suit bearing number 04 of 2008 is pending in the High Court of Sindh Karachi. In both the above said suits we are arrayed as defendants. Copies of the said permission letters granted to the group of Mst. Afroze Shah and the group of Mr. Sabir Qureshi are annexed and marked as Annexure ‘FF’ & Annexure ‘GG’ are for reference! 

 

C7) That we are sorry to say that we did not expect the officials subordinate to Your Excellency shall behave in a fashion as stated above. We may mention that unless a civil suit is filed from us against the removal of Mst. Afroze Shah and others from the Islamic Education Trust until than the Educational Institution situated in the Islamia College Complex Building Karachi may not be saved! We may also mention that the Advocate General Sindh is there to safeguard and protect the group of Mst. Afroze Shah and others by refusing us to grant permission under section 92 CPC with out which not any trust civil suit will be maintained!  

 

C8) We therefore, request Your Excellency to look into the matter personally and may call upon the Advocate General of Sindh not to frustrate the object of saving the Educational Institution situated in the Islamia College Complex Building Karachi.

 

C9) Once again we state that the ill designs of Mst. Afroze Shah and her group may only be stopped from becoming a reality if they are judicially removed from the Islamic Education Trust. We may mention that the current Official Assignee of Karachi is in hands and gloves with Mst. Afroze Shah and also with her group.

 

D) We hope that Your Excellency shall take personal interest for the sake to secure thousands of student’s education in the above matter and kindly do the needful. An early positive action and early positive reply is kindly requested.

C) That Mrs. Afroze Shah wife of Mr. Syed Anwar Ali Shah, who is claiming to be a trustee of Islamic Education Trust and the Official Assignee Karachi, Mr. Kadir Bukhsh Umrani, are partners and both want to grab the Islamia College Complex Building in Karachi.  Advocate Mr. Naeem Suleman (For Official Assignee, Karachi) is in civil case of execution number 17 of 2008 in the court of 3rd Rent Controller, East, Karachi, (Islamic Education Trust through Official Assignee Karachi Mr. Kadir Buksh Umrani V/s City District Government Karachi and Others) and this same Advocate (For Mrs. Afroze Shah) is in criminal revision number 53 of 2008 in the High Court of Sindh, in Karachi (Mr. Muhammad Hussain Qureshi V/s Mrs. Afroze Shah). That the same person Mr. Naeem Suleman is the Advocate for Mrs. Afroze Shah and Mr. Kadir Buksh Umrani (Both Mrs. Shah and Mr. Umrani Are Against Twenty Thousand Students Education And Both Mrs. Shah and Mr. Umrani Are In Favor For Eviction of Educational Institutions In Government Islamia College In Karachi) which is very clear evidence that the two are partners and want to grab the aforesaid building.


D) That Ms. Afroze Shah wife of Mr. Syed Anwar Ali Shah, who is claiming to be a trustee of Islamic Education Trust and the Official Assignee Karachi, Mr. Kadir Bukhsh Umrani, are partners and both want to grab the Islamia College Complex Building in Karachi. Syed Ameer Ali Shah (current Taluka Nazim Bhiria in Sindh) r/o Syed Mohalla, Bhiria, Noushehro Feroz II, Sindh, Pakistan, who is also claiming to be a trustee of Islamic Education Trust and the Official Assignee Karachi, Mr. Kadir Bukhsh Umrani, are also partners and all of them want to grab the Islamia College Complex Building & Land in Karachi. That Mr. Syed Mureed Ali Shah appear on every date of hearing as Official Assignee Karachi, Mr. Kadir Bukhsh Umrani’s Advocate Mr. Naeem Suleman’s Associate Advocate in the court of 3rd Additional District Judge East Karachi for first rent appeal number 69 of 2008 (Principal Islamia Law College Karachi V/s The Official Assignee of Karachi) and in the court of 3rd Rent Controller, East, Karachi, for civil case of execution number 17 of 2008 (Islamic Education Trust through Official Assignee Karachi Mr. Kadir Buksh Umrani V/s City District Government Karachi and Others) Why? Because Mr. Shah and Mr. Umrani Are Against Twenty Thousand Students Education And Both Mr. Shah and Mr. Umrani Are In Favor For Eviction of Educational Institutions In Government Islamia College In Karachi) which is also another very clear evidence that the three are partners and want to grab the aforesaid building.

 

F) We may mention that the current Official Assignee of Karachi’s office and may be current Advocate General of Sindh’s office is in hands and gloves with Mrs. Afroze Shah w/o Syed Anwar Ali Shah and also with her group.

Syed Ameer Ali Shah (current Taluka Nazim Bhiria in Sindh) r/o Syed Mohalla, Bhiria, Noushehro Feroz II, Sindh, Pakistan, who is also claiming to be a trustee of Islamic Education Trust and the Official Assignee Karachi, Mr. Kadir Bukhsh Umrani, are also partners and both of them want to grab the Islamia College Complex Building & Land in Karachi. That Mr. Syed Mureed Ali Shah appear on every date of hearing as Official Assignee Karachi, Mr. Kadir Bukhsh Umrani’s Advocate Mr. Naeem Suleman’s Associate Advocate in the court of 3rd Additional District Judge East Karachi for first rent appeal number 69 of 2008 (Principal Islamia Law College Karachi V/s The Official Assignee of Karachi) and in the court of 3rd Rent Controller, East, Karachi, for civil case of execution number 17 of 2008 (Islamic Education Trust through Official Assignee Karachi Mr. Kadir Buksh Umrani V/s City District Government Karachi and Others) Why? Because Mr. Shah and Mr. Umrani Are Against Twenty Thousand Students Education And Both Mr. Shah and Mr. Umrani Are In Favor For Eviction of Educational Institutions In Government Islamia College In Karachi) which is also another very clear evidence that both are partners and want to grab the Islamia College Complex Building in Karachi..

 

C) That the current Advocate General Sindh office first refused to grant us permission under section 92 CPC in June 2008, then in August 2008 and again in December 2008, while the office of Advocate General Sindh granted permission on January 23, 2008, to Mrs. Afroze Shah and others from her group even after they filed a civil suit (Civil Suit No. 107 of 2008) in the High Court of Sindh in Karachi on 10th January, 2008.

 

D) We All Do Not Want To Allow Any One To Repeat The History Of Lal Masjid (Red Mosque) Islamabad In Islamia College Complex Building Karachi. (Why?) Because Students In Islamia College Complex Building Karachi Are Equally Important As Our Own Children!

B) If the Sindh Government pays dues to the Islamic Education Trust, the money should be distributed among deserving students for scholarship and other welfare projects and a society should be established for the purpose and the rent money (dues); should not be given to trustees since there were chances of corruption and misuse of funds.

 

C) That the first rent agreement signed between Quaid-i-Taleem Late Mr. A. M. Qureshi, one of the founder trustee of the Islamic Education Trust as party one and Late Mr. G. M. Khan, the Principal of Islamia College (as member of Islamic Education Society) as party two in August 1961.

 

D) That Islamic Education Trust became landlord and Islamic Education Society became leaseholder of the land. This first rent agreement is a foundation in rent case 413 of 2004 (The Official Assignee of Karachi V/s CDGK and Others). However Mr. Qureshi could not sign the agreement unless all the trustees give him powers to do so. In other wards one trustee cannot sign a rent agreement unless all the trustees pass a resolution to give him/her the power to do so. Mrs. Mumtaz Qureshi Muzakkir Hussain one of the founder trustee confirmed us that no such resolution was passed, rendering the agreement void. That is a reason till today no one including current Official Assignee of Karachi did not submitted this resolution in any court! How can the current Official Assignee of Karachi take possession of the building on the basis of a void agreement?

B) That the Official Assignee Karachi is directed by Honourable High Court of Sindh Karachi in Constitutional Petition Number D-96 of 2001 order dated 07-09-2001 “ …to assume the power of the owner of the property and take such measures as he considers necessary or expedient to protect the owners’ interest in accordance with the Trust Deed”.

 

C) That according to the Islamic Education trust deed of 1958 there is no clause in the Islamic Education Trust deed for eviction of educational institutions in Islamic Education Trust’s property.

 

D) That according to the Islamic Education trust deed of 1958 there is no clause in the Islamic Education Trust deed for collection of rent from educational institutions in Islamic Education Trust’s property.

 

E) That the Official Assignee Karachi is not protecting the owner’s interest in accordance with the Islamic Education Trust deed of 1958.

 

F) That the Official Assignee Karachi is never ever directed/authorized by the Honourable High Court of Sindh Karachi to seek eject of the educational institutions in Islamic Education Trust’s property.

 

G) We hope that you shall take personal interest for the sake to secure thousands of student’s education in the above matter and kindly do the needful.

That Mr. Syed Mureed Ali Shah appear on every date of hearing as Official Assignee Karachi, Mr. Kadir Bukhsh Umrani’s Advocate Mr. Naeem Suleman’s Associate Advocate in the court of 2nd Additional District Judge East Karachi for first rent appeal number 69 of 2008 (Principal Islamia Law College Karachi V/s The Official Assignee of Karachi) and in the court of 3rd Rent Controller, East, Karachi, for civil case of execution number 17 of 2008 (Islamic Education Trust through Official Assignee Karachi Mr. Kadir Buksh Umrani V/s City District Government Karachi and Others) Why? B) If the Sindh Government pays dues to the Islamic Education Trust, the money should be distributed among deserving students for scholarship and other welfare projects and a society should be established for the purpose and the rent money (dues) should not be given to trustees since there were chances of corruption and misuse of funds.

 

We also have no objection for the sake of education and security of thousands of students if the Sindh Government acquire Government Islamia College Complex Building Karachi.
